MARRIAGE PAPERWORK REQUIREMENTS FOR USA CITIZENS TO MARRY IN ITALY
US citizens to be married in Italy must present the following documents:
- VALID U.S. PASSPORT or, if a member of the Army forces, an identification card;
- A certified copy in “long firm” of the BIRTH CERTIFICATE containing the name of both mother and father. Birth certificate has to be TRANSLATED into Italian and be legalized with an APOSTILLE which is a seal affixed to a public record by the Secretary of State Notary Public of the State where the document was originated from. The translation has to be certified by a Consular Officer and then Apostilled by the Secretary of State Notary Public of the State where it was certified.
- A FINAL DIVORCE DECREE (if applicable) OR DEATH CERTIFICATE of the previous spouse. A TRANSLATION of this document into Italian is required as well as its APOSTILLE.
- When obtaining the required birth certificate or divorce decree if applicable ASK THE ISSUING OFFICE FOR INSTRUCTION AND FEES FOR OBTAINING AN APOSTILLE.
- ATTO NOTORIO (to be done in the States or in Italy if time doesn’t allow): Is a declaration sworn by 4 witnesses before an Italian Consular Officer stating that there is no obstacle to his/her marriage. You must call your nearest Italian Consulate and set up an appointment for this to be done. Ask how many witnesses are needed. IMPORTANT: This can not be issued more than 3 months before the wedding otherwise it will expire.
- NULLA OSTA OR SWORN STATEMENT (To be done in Italy): This document has to be done it before an U.S. Consular Officer (can be done in Milan, Trieste near Venice, Florence, Rome and Naples). This is a declaration stating that there is no obstacle according to USA laws for the marriage to take place in Italy. Witnesses are not required. Once this document has been issued has to be authenticated at the Prefecture.

MARRIAGE REQUIREMENTS FOR BRITISH NATIONALS TO MARRY IN ITALY
Before the marriage of a British National may be celebrated in Italy, the authorities normally require a Consular Certificate of No Impediment (called Nulla Osta) to be produced. This certificate may be obtained in the following way:
Where both party are British National residing in UK they must give notice of Marriage to a UK Superintending Registrar. After 23 days of the publications of banns the registry office releases a document (UK Certificate of No Impediment) that has to be presented to the Consular office in whose district the marriage will take place united with the following documents:
- Long Form of Birth certificates (showing name of parents). Original document
- Passport; first 5 pages of old format passport or last page of new European format
- Consent of parent or guardian when under the age of 18
- Evidence of termination of any previous marriage if applicable (i.e. death certificate or divorce decree absolute
- UK Certificate of No Impediment (when notice of marriage given in UK)
After a couple of days the Consulate will release a Nulla Osta that has to be presented to the Registry Office where the Marriage will take place.
These procedures can be easily done via correspondence and our office can assist you step by step supervising that all your documents are properly completed.
Fees for issuing a Consular Certificate of No Impediment:
- Around € 58 euro + € 5.00 if cheque via correspondence from UK (Cost may vary from Consular Offices.
PAPERWORK PROCUDERES CAN BE SLIGHTLY DIFFERENT IF:
- Both are British Citizens nor resident in UK
- British National is marrying a non-British National, and resides in Italy
- British National Is marrying a non – British National and resides in UK (except Scotland)
- British National is marrying an Irish citizen and resides in UK
- British National is residing in Scotland
